Communications from us
If we have your contact details, we may send you important notices by email from time to time, including notices about changes to this website or to these terms.
Law and jurisdiction
These terms, and the relationship between you and us whether contractual or otherwise, are governed by and construed in accordance with English law. If you are a consumer, you benefit from any mandatory provisions of the law of your country of residence, and nothing here reduces your legal rights as a consumer.
If you are a consumer, any dispute between you and us relating to these terms or to that relationship is subject to the jurisdiction of the courts of England, Wales, Scotland or Northern Ireland, as determined by your residency. If you are a business user, any such dispute is subject to the exclusive jurisdiction of the courts of England and Wales.
Part 2 — Booking a session
How to book
You can request a booking for a Shaping Little Minds session in any of these ways:
- through the booking page on this website, which sends us your booking request;
- by messaging us on WhatsApp or emailing info@shapinglittleminds.co.uk;
- by telephoning us on the number shown on our contact details.
By placing a booking request you confirm that you are at least 18 years old. If you are under 18 you may not place a booking request. When you book you must give us complete and accurate information, and complete and accurate payment information where payment is taken.
When a contract with us is formed
We accept your booking request only when we send you a booking confirmation email. At that point a contract comes into existence between you and us which includes these terms. If you do not receive a booking confirmation email, please contact us.
If the person making the booking is not the person who will accompany the child and have care and control of them at the session (the carer), the person making the booking is responsible for making sure the carer has read and complies with these terms, and is responsible for the behaviour of the carer and for any breach of these terms by the carer.
If we are unable to accept your booking request we will tell you and no contract will be formed. In that case you will not be charged, or if you have already paid you will be refunded.
Arrival times, and what to bring
Sessions last 45 minutes. Doors open at the time the session starts: if you arrive earlier you will need to wait inside or outside the venue while the session is being set up. If you are late you can still join, as long as you come in quietly so the other children are not disrupted.
Our sessions can include messy activities, so we recommend bringing spare clothes for your child. You may bring a snack. Please note that nuts, and any food containing nuts, are not allowed in any of our sessions.
Changes we may need to make
We may occasionally have to change a session to reflect changes in the law, in health and safety requirements or in regulatory requirements. These changes will not affect your use of the session.
If we make a change that materially affects your rights under these terms or your use of a session, we will notify you when the change takes effect and give you the opportunity to end the contract before it does and receive a refund for any session paid for but not yet delivered.
Changing your booking
You can request a change up to 12 hours before the session. If you want to change the time, date or venue of a booked session, contact us and we will tell you whether the change is possible, along with any change to the price or timing that would result, and ask you to confirm whether you want to go ahead. If the change cannot be made, or the consequences are unacceptable to you, you may wish to end the contract as set out below.
Cancellations
You can cancel your booking at any time within 7 calendar days of the date the contract between you and us is first formed. To do so, you must tell us in writing of your decision to cancel within that cancellation period.
Please read this carefully, as it affects your ability to cancel: if you start or attend sessions during the cancellation period and then exercise your right to cancel while that period is still running, you must pay for the sessions that have already been delivered to you up to the date you cancelled.
Refunds
Any refund due to you will be made as soon as possible. If you are cancelling within the cancellation period and are entitled to a refund, it will be processed no later than 14 days after the date we received your notice to cancel.
An amount for any session delivered to you during the cancellation period may be deducted from your refund, in proportion to what has been delivered compared with the full contract. All refunds are issued using the same method you used to pay, unless you expressly agree otherwise.
Your responsibilities
You promise to us that:
- the information you gave when booking is complete and accurate, and that you will tell us of any changes;
- when attending a session, neither you nor any carer nor the child attending will knowingly be suffering from any infectious or contagious disease;
- when attending a session, neither you nor any carer will use photographic or recording equipment;
- the child attending will be accompanied by you or your carer and will be under the direction, care and control of you or your carer at all times, and that you or your carer are solely responsible for their welfare and conduct during the session;
- you will comply, and will make sure any carer complies, with all health and safety rules and procedures in place at the venue;
- you will compensate us on demand for any loss, liability, costs and expenses we suffer or incur as a result of any breach of this section by you or your carer.
We are not medically trained
We give you the option to tell us about the health and needs of your child so that we are better prepared to run the session. You acknowledge that our staff are not medically trained and are not qualified to assess whether you or your child are fit and well enough to take part. Please contact your GP if you are in any doubt before starting. If you or your child feel unwell before or during a session, please tell the staff as soon as possible.
Our right to exclude
You, your carer and any child accompanying you may be excluded from a session, either permanently or for a period we specify, if in our opinion the behaviour of you, your carer or any accompanying child is unacceptable, seriously disruptive, or puts other children or adults at risk.
In those circumstances the price paid will not be refunded and we will resume the session as soon as we are able to. If you, your carer or any accompanying child is permanently excluded, or you decide to cancel the contract, we will refund any amount you have paid in advance for the part of the sessions not yet delivered.
Your legal rights
As a consumer you have legal rights in relation to our sessions. Advice about your legal rights is available from your local Citizens Advice, at citizensadvice.org.uk. Nothing in these terms affects those legal rights.
